Mitchell clarifies a payment receipt “for the Hebrew translation rights to ‘Gone With The Wind’”

TLS signed “Margaret Mitchell Marsh,” one page, 8.5 x 11, personal letterhead, April 29, 1946. Letter to Elias Newman of the Scopus Publishing Company, in full: “I have received your check for $40.00 which was enclosed in your letter of April 25th. Thank you for it. Your brother, Mr. Mordecai Newman, informed me that he had instructed you to pay me this sum. I will let Mr. Mordecai Newman know that I have received it. Your letter enclosed two copies of the following receipts

‘Received from Mordecai Newman, publisher, of Tel-Aviv, Palestine (Elias Newman, attorney) the sum of Forty Dollars (representing Ten Pounds Palestinian currency) for the Hebrew translation rights to ‘Gone With The Wind.’

You requested that I sign them and return them to you for your files. I am unable to do this, as these receipts do not correctly state my business arrangement with your brother, Mr. Mordecai Newman, in connection with the sale of the rights for a Palestine edition of ‘Gone With the Wind.’ The receipt sent me gives the impression that the $40.00 constitute full payment for the ‘Hebrew translation rights to ‘Gone With the Wind.’’ Actually the $40.00 are not payment in full for the entire Hebrew translation rights. They represent payment in full for only the first 2500 copies. Thereafter my royalties of five per cent and ten per cent begin. I am copying the clauses in my contract with Mr. Mordecai Newman which deal with the matter of royalties:

‘5. The Publisher will on signing this Agreement pay to the Author the sum of Forty U.S. Dollars ($40), and this Agreement shall not become effective until such payment has been made.

‘6. The payment specified in the preceding paragraph shall be payment in full on the first twenty-five hundred (2500) copies sold of the said translation. The terms of payment after the first twenty-five hundred (2500) copies sold shall be as follows: 5% (Five per cent) of the published retail price of all copies sold up to Five Thousand (5000) copies; 10% (Ten per cent) of the published retail price of all copies sold over and above Five Thousand (5000) copies.

‘7. The Publisher will render to the Author semi-annual statements of the number of copies of the said translation sold, and of the royalties due thereon, on or before the last day of August and the 1st day of February of each year, for the sales made up to June 30th and to December 31st previous, and will make a settlement of the account in cash within one month after the statement dates respectively.’ I hope that the enclosed two copies of a receipt will suffice for your files.” In fine condition, with some small chipping to the edges.
